Terms and Conditions

These Terms and Conditions (“Agreement”) govern the use of VIP concierge services (“Services”) provided by THE GUESTLIST MIAMI (“Company,” “we,” “us,” or “our”) to clients (“Client,” “you,” or “your”). By booking, using, or receiving any of our Services, you acknowledge that you have read, understood, and agree to be bound by this Agreement.
1. Scope of Services
Our Services may include but are not limited to:
- VIP guest list access through hosts or promoters
- Complimentary VIP tables, admission, and drinks through hosts or promoters
- Yacht charters and private maritime experiences through yacht brokers
- High-end restaurant reservations
- Custom-curated nightlife and hospitality experiences
The availability and delivery of Services are subject to third-party venues, vendors, and host/promoter arrangements. THE GUESTLIST MIAMI does not own or operate any of the venues or third-party service providers.
2. Eligibility
Clients must be at least 21 years old to use Services involving alcohol or nightlife experiences, unless otherwise explicitly permitted under local law and venue policy.
Clients must comply with all local laws, venue regulations, dress codes, and entry policies. Failure to meet venue or legal requirements may result in denied entry or service.
3. Concierge Fee and Payment Terms
- A non-refundable concierge fee will be charged at the time of booking depending on the scope of services.
- This fee secures coordination and access to promoters, VIP Hosts, Yacht Brokers but does not represent a purchase of alcohol, cover charge, or venue entry fees (unless explicitly included).
- Payments must be made in full prior to service delivery, unless otherwise agreed in writing.
4. Non-Refundable Policy
All concierge fees are strictly non-refundable under any circumstances, including but not limited to:
- Client cancellations or schedule changes
- No-shows
- Failure to gain entry due to dress code, age, or conduct
- Dissatisfaction with third-party services
- Refusal to accept reasonable alternative arrangements
5. Changes, Rescheduling, and Availability
We will make reasonable efforts to accommodate changes or rescheduling requests within the same scope of service. However:
- Changes are subject to availability and third-party vendor schedules
- Availability of alternative options is not guaranteed
6. Third-Party Services and Liability
- Many services are fulfilled through independent third-party providers, including but not limited to hosts, promoters, restaurants, nightclubs, yacht operators, and drivers.
- THE GUESTLIST MIAMI acts solely as a liaison or coordinator and does not assume responsibility for the actions, omissions, or service quality of third parties.
- Any disputes or claims regarding third-party performance must be addressed directly with the provider.
7. Admission and Experience Disclaimer
While we strive to provide seamless VIP access and premium experiences, admission to venues and the quality or specifics of services (e.g., seating, complimentary items, or overall experience) cannot be guaranteed due to factors outside our control, including but not limited to:
- Venue capacity limits
- Guest behavior or failure to meet dress code and age requirements
- Management discretion at the venue
- Weather conditions affecting outdoor or yacht experiences
- Changes made by third-party hosts or promoters
All arrangements are provided on a best-effort basis, and THE GUESTLIST MIAMI shall not be held responsible for any denied entry, substitutions, or variations in the final experience due to third-party policies or unforeseen circumstances.
8. Client Conduct and Responsibilities
Clients must:
- Arrive on time as instructed by the VIP host or concierge
- Adhere to all instructions regarding dress codes, etiquette, and legal requirements
- Act respectfully toward staff, hosts, and third-party personnel
Failure to comply may result in service denial or cancellation without refund.
9. Event Cancellations by Venues or Vendors
In the rare event of venue or vendor cancellation, we will:
- Make every effort to secure alternative arrangements of similar value and style
- Offer a curated list of alternative options
If alternatives are offered and declined by the Client, the concierge fee remains non-refundable.
10. Limitation of Liability
To the fullest extent permitted by law:
- THE GUESTLIST MIAMI shall not be liable for any loss, damage, injury, delay, or inconvenience arising from the use of third-party services, acts of God, transportation issues, or client misconduct.
- In no event shall our total liability exceed the amount of the concierge fee paid.
11. Force Majeure and Blackout Dates
THE GUESTLIST MIAMI shall not be held liable for any failure to perform, delay, or disruption in the provision of services due to circumstances beyond our reasonable control. These may include, but are not limited to:
- Natural disasters (e.g., hurricanes, earthquakes, floods)
- Labor strikes or work stoppages
- Government actions or restrictions (e.g., curfews, travel bans, or new regulations)
- Public health emergencies or pandemics
- Acts of terrorism or civil unrest
- Utility failures or technology outages
- Venue closures, overbooking, or event cancellations by third-party providers or venue operating partners
Additionally, blackout dates (e.g., major holidays, large-scale city events, or peak weekends) may impact availability, access, or the fulfillment of services. We will make reasonable efforts to inform clients of known blackout dates and assist with rescheduling where possible; however, we cannot guarantee service availability or alternatives during these times.
In all such cases, no refunds shall be issued, and THE GUESTLIST MIAMI shall not be held responsible for any losses, damages, or inconvenience resulting from force majeure events or affected blackout periods.
12. Privacy and Data Use
Client information is collected solely for the purpose of delivering Services and will be treated with confidentiality in accordance with our Privacy Policy. We do not sell or share your personal data without your consent.
13. Governing Law and Dispute Resolution
This Agreement shall be governed by the laws of the State of Florida, without regard to conflict-of-law principles. Any disputes shall be resolved exclusively in the courts located in Florida.
14. Amendments and Modifications
We reserve the right to amend these Terms and Conditions at any time. Continued use of our Services constitutes acceptance of any modified terms.
15. Acknowledgment and Acceptance
By booking, reserving, or otherwise using our Services, the Client confirms that they have read, understood, and agreed to all of the above terms and conditions.
